1. Acceptance of Terms

By accessing or using BoothHustler ("Service", "we", "us"), you ("Customer", "you") agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.

2. Description of Service

BoothHustler provides a SaaS platform enabling sales teams to capture, process, and manage leads at trade shows and events through an AI-assisted Telegram bot interface.

3. Data Responsibilities and Compliance

3.1 You Are the Data Controller.You are the data controller under applicable privacy laws (including GDPR) for personal data of individuals whose information is captured via the Service ("Lead Data"). BoothHustler acts solely as a data processor on your behalf.

3.2 Your Compliance Obligations. You must: inform individuals their information is being captured and may be processed by AI; maintain records of lawful bases for processing; comply with all applicable data protection laws; not collect sensitive personal data without explicit consent.

3.3 Trade Show Context.Collecting business contact information at professional trade shows may constitute a lawful basis under GDPR Art. 6(1)(f) "legitimate interest", provided you limit collection to professional contact info, use data only for the original purpose, and honor opt-out requests.

4. Voice and Audio Processing

Audio recordings are processed transiently (max 24h retention) to extract lead information. Audio is not permanently stored. AI transcription is performed by Google (Gemini) and OpenAI (Whisper). You must not record individuals without their consent where prohibited by law.

5. Data Processing Agreement

By using the Service you enter into a DPA per GDPR Art. 28. BoothHustler will: process data only on your instructions; implement appropriate security measures; assist with data subject rights requests; delete all data upon termination within 30 days.

Sub-processors:

  • Google (Gemini AI — transcription and extraction)
  • OpenAI (Whisper — audio transcription)
  • Supabase (data storage)
  • Vercel (hosting)

6. Prohibited Uses

  • Collect data on individuals who have opted out
  • Collect data on minors under 16
  • Engage in harassment or unlawful targeting of individuals
  • Reverse engineer the Service
  • Violate any applicable local, national, or international law

7. Limitation of Liability

To the maximum extent permitted by law, BoothHustler shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the greater of amounts paid in the prior 12 months or €100 EUR.

8. Disclaimer of Warranties

The Service is provided "as is". We do not warrant accuracy of AI-extracted lead data. You are responsible for verifying AI output.

9. Governing Law

These Terms are governed by the laws of Portugal (EU). Disputes shall be resolved in courts of Lisbon, Portugal.
